In baseball, plate umpires are asked to make difficult perceptual judgments on a consistent basis. This chapter addresses some neuro-psychological issues faced by umpires as they call balls and strikes, and whether it is ethical to ask fallible humans to referee sporting events when faced with technology that exposes “blown” calls.

Moral value as it was understood by Nicolai Hartmann and by Max Scheler belongs uniquely to volitions or willings, to dispositions to will and to persons as beings capable of willing. Moreover, as understood in this paper as well as by Hartmann, Scheler, and Husserl, every volition necessarily involves if not actual valuings then reference to retained valuings and potential valuings as well as to cognitive mental phenomena. As used here, the terms 'volition' and 'willing' denote mental traits, such as (...) lived experiences and habits insofar as they either do or can occur actively. A trait of a mind or "monad" can have moral value — in contrast to utility, for example — only (would belong) insofar as it is or can be or could have been engaged in and so performed by the person or ego to whose mind the trait belongs . The classification of lived experiences as voluntary or not voluntary cuts across the three-fold classification of mental processes as cognitive, affective, or conative. This seems to be the most appropriate way of distinguishing the voluntary from the involuntary. Voluntary mental phenomena are characterized by the engagement of the ego in some lived experience occurring in the flux of its lived experiences, i.e., by taking position. The ‘black box problem’ is a long-standing talking point in debates about artificial intelligence. This is a significant point of tension between ethicists, programmers, clinicians and anyone else working on developing AI for healthcare applications. However, the precise definition of these systems are often left undefined, vague, unclear or are assumed to be standardised within AI circles. This leads to situations where individuals working on AI talk over each other and has been invoked in numerous debates between opaque and explainable (...) systems. This paper proposes a coherent and clear definition for the black box problem to assist in future discussions about AI in healthcare. We often feel survivor guilt when the very circumstances that harm others leave us unscathed. Although survivor guilt is both commonplace and intelligible, it raises a puzzle for the standard philosophical account of guilt, according to which people feel guilt only when they take themselves to be morally blameworthy. The standard account implies that survivor guilt is uniformly unfitting, as people are not blameworthy simply for having fared better than others. In this paper, we offer a rival account of guilt, (...) the relational account of guilt, which makes sense of survivor guilt and other forms of guilt without self-blame while preserving the intelligibility of guilt about culpable wrongdoing. According to this account, guilt involves the feeling of being unable to justify ourselves to others, and we lack self-justification when we (however blamelessly) stand on the positive side of an undesirable asymmetry with them. When someone survives something that those around her do not, the disparity in outcome constitutes an asymmetry that is often undesirable, because it arises from luck or violates a requirement of solidarity. Philip Reed argues that laws that grant people access to euthanasia on the basis of terminal illness are discriminatory. In support of this claim, he offers an argument by analogy: it would be discriminatory to offer a person access to euthanasia because they are women or because they are disabled, as such restricted access would send the message ‘that life as a woman or as a disabled person is (very often) not worth living’.1 And so it must also be discriminatory (...) to offer people access to euthanasia because they are terminally ill. Arguments by analogies are only as good as the analogies on which they are built. Having a terminal illness, I’m going to suggest, is not relevantly similar enough to either being disabled or being a member of an oppressed social group to make Reed’s claim compelling. Let’s explore each branch of the analogy in turn. Why think that terminal illness is relevantly unlike disability, in a way that makes offering access to euthanasia in the latter case discriminatory, but not the former? In this article, we discuss vaginal microbiota transplantation as “the next frontier” in microbiota transplantation and identify the medical, regulatory, and ethical challenges related to this nascent field. We further discuss what we anticipate will be the first context for testing VMT in clinical trials, prevention of the (...) recurrence of a condition referred to as bacterial vaginosis. Dabei stehen die Fragen, welche die Anwendung des Schemas `Auffassung - Auffassungsinhalt' auf das Zeitbewusstein und die Gefahr des unendlichen Regresses betreffen, noch immer im Vordergrund. Es ergeben sich aber auch entscheidende neue Einsichten. Diese betreffen vor allem das auf die Zukunft gerichtete `protentionale' Zeitbewusstsein in seiner Verflechtung mit der `Retention' der Vergangenheit sowie eine spezifisch noematische Bestimmung der (...) Zeitmodalitäten, die zu einer neuen Phänomenologie der Individuation führt. This paper analyzes the ethical themes and theory portrayals by particular characters in Star Trek: Into Darkness. It is concluded that the film can be understood as explicating the pros and cons of both "male" and "female" ethical perspectives, and that a comprehensive understanding of morality requires some synthesis of both perspectives.

Are demands for equality motivated by envy? Nietzsche, Freud, Hayek, and Nozick all thought so. Call this the Envy Objection. For egalitarians, the Envy Objection is meant to sting. Many egalitarians have tried to evade the Envy Objection.. But should egalitarians be worried about envy? In this paper, I argue that egalitarians should stop worrying and learn to love envy. I argue that the persistent unwillingness to embrace the Envy Objection is rooted in a common misunderstanding of the nature of (...) the charge, what it reveals, and what can be said in response to it. I develop what Bernard Williams might call a vindicatory genealogy of envy, thereby allowing us to see that envy, rather than undermining egalitarian intuitions, can in fact play a distinct justificatory role (when it is fitting), which undermines the Envy Objection. Strawson (1994) and Peacocke (1992) introduced thought experiments that show that it seems intuitive that there is, in some way, an experiential character to mental events of understanding. Some (e.g., Siewert 1998, 2011; Pitt 2004) try to explain these intuitions by saying that just as we have, say, headache experiences and visual experiences of blueness, so too we have experiences of understanding. Others (e.g., Prinz 2006, 2011; Tye 1996) propose that these intuitions can be explained without positing experiences of understanding. (...) Call this the debate between Realism and Anti-Realism about experiences of understanding. This paper aims to advance that debate in two ways. In the first half, I develop more precise characterizations of what Realists and Anti-Realists propose. An important philosophical issue in the study of addiction is what difference the fact that a person is addicted makes to attributions of autonomy (and responsibility) to their drug-oriented behavior. In spite of accumulating evidence suggesting the role of emotional dysregulation in understanding addiction, it has received surprisingly little attention in the debate about this issue. I claim that, as a result, an important aspect of the autonomy impairment of many addicted individuals has been largely overlooked. A widely shared assumption (...) in the philosophical literature is that for addiction to impair a person’s autonomy it has to make them (in some sense) take drugs against their will. So-called “willing addicts” are therefore usually seen as exempted from the autonomy impairment believed to characterize “unwilling addicts”, the latter being those who ‘truly want’ to stop using drugs but find their attempts repeatedly derailed by failures of self-control. In this article, I argue that the association between addiction and emotional dysregulation shows why this assumption is false. Emotional dysregulation is not only consistent with the possibility that many addicts take drugs ‘willingly’, it supports the hypothesis that they use drugs because they truly want to. The article proposes an explanation for why emotional dysregulation should nevertheless be seen as an aspect of their loss of control and an important reason why they have impaired autonomy. I end by exploring some implications of this account for addict’s decision-making capacity when they are prescribed the drugs to which they are addicted. -/- . (shrink)

This essay explicates the primary interpretative import of B1: 31-32 in Parmenides poem (On Nature)—lines which have radical implications for the overall argument, and which the traditional arrangement forces into an irreconcilable dilemma. I argue that the “negative” reading of lines 31-32 is preferable, even on the traditional arrangement. This negative reading denies that a third thing is to be taught to the reader by the goddess—a positive account of how the apparent world is to be “acceptably” understood. I then (...) suggest that a rearrangement of the fragments would make more sense overall, while further supporting the “negative” reading as more natural and coherent. In particular, the rearrangement dispels the objection that, “if mortal opinions were not true, why would Parmenides include such a lengthy false account of the apparent world--an account which explicitly denies the conclusions of the earlier section, Truth?”. The #MeToo movement generated a feminist insistence that we “believe women.” But the men accused of assault, harassment, and other violations frequently defended themselves with the insistence that they had always “respected women” – sometimes, going so far as to get numerous women to sign letters swearing that these men had always respected them. This common MeToo defense reveals the core inconsistency – and the core entitlement – at the heart of misogyny and sexual injustice: some women deserve respect. But (...) the duty to respect those women relies on an invisible entitlement to disrespect – indeed, to assault, harass, dominate, or exploit – others. This chapter explores consent’s role within the superstructure of misogyny and sexual injustice, arguing what consent is a key apparatus of white supremacy. It argues that consent has been constructed through dynamics of colonial and racist sexual entitlement, mapping some (white) women as deserving of respect and the right to consent, while marking other women as expendable or disposable within the sexual economy. This means not only that consent is historically constructed as white, but also that whiteness, and in particular, white womanhood, is constructed through consent. Thus, white women’s right to consent – or to refuse – is premised upon the inability of other women to do so. In this way, the right to sexual consent does not disrupt the norm of male sexual entitlement. Consent has always been premised on non-consent, from coloniality and slavery to contemporary porn, which offers a vision of the world without proper consent, so that granting consent to actual women is an exceptional practice, an “act of respect.” By including race and class alongside gender in my analysis of consent, I argue that contemporary feminist visions of sexual justice must do more than defend or ameliorate consent, but develop intersectional interrogations of sexual justice that reckon with the complicities of consent. Edmund Gettier is Professor Emeritus at the University of Massachusetts, Amherst. This short piece, published in 1963, seemed to many decisively to refute an otherwise attractive analysis of knowledge. It stimulated a renewed effort, still ongoing, to clarify exactly what knowledge comprises.

Impairment of self-control is often said to be a defining feature of addiction. Yet many addicts display what appears to be a considerable amount of control over their drug-oriented actions. Not only are their actions clearly intentional and frequently carried out in a conscious and deliberate manner, there is evidence that many addicts are responsive to a wide range of ordinary incentives and counter-incentives. Moreover, addicts have a wide variety of reasons for using drugs, reasons which often seem to go (...) a long way towards explaining their drug-oriented behavior. Many use drugs, for example, to cope with stressful or traumatic experiences. In this article I argue that some standard philosophical explanations of addicts’ impairment of self-control are inadequate, and propose an alternative. (shrink)

Personalized genomics companies (PG; also called ‘direct-to-consumer genetics’) are businesses marketing genetic testing to consumers over the Internet. While much has been written about these new businesses, little attention has been given to their roles in science communication. This paper provides an analysis of the gene concept presented to customers and the relation between the information given and the science behind PG. Two quite different gene concepts are present in company rhetoric, but only one features in the science. What is self-control and how does the concept of self-control relate to the notion of will-power? A widespread philosophical opinion has been that the notion of will-power does not add anything beyond what can be said using other motivational notions, such as strength of desire and intention. One exception is Richard Holton who, inspired by recent research in social psychology, has argued that will-power is a separate faculty needed for persisting in one's resolutions, what he calls 'strength of will'. However, (...) he distinguishes strength of will from self-control. In this paper I argue that will-power is essential also to a certain form of self-control. I support this claim by arguments showing that the traditional philosophical accounts of self-control run into difficulties because they pay insufficient attention to will-power as an independent source of motivation. This Element examines Kant's innovative account of labour in his political philosophy and develops an intersectional analysis of Kant. By demonstrating that Kant's analysis of slavery, citizenship, and sex developed in inter-linked ways over several decades, culminating in his development of a 'trichotomy' of Right, the author shows that Kant's normative account of independence is configured through his theory of labour, and is continuous with his anthropological accounts of race and gender, providing a systemic justification for the dependency of women (...) and non-whites embedded in his philosophy of right. By examining Kant's arguments about slavery as intertwined with his account of domestic labour, the author argues that his ultimate rejection of slavery may owe more to his changing conceptualization of labour than to his theory of race, and that his final arguments against slavery rehearse strategies for embedding intersectional patterns of domestic dependence in his account of the rightful state. Warranting further examination is how the nascent philosophical tradition initially spread to this region from its Ionian provenance. Despite numerous ancient attestations that Parmenides of Elea was influenced, or even directly instructed, by the Ionian-born Xenophanes, many modern scholars remain skeptical of this historical association. The extent of this skepticism ranges from cautious uncertainty to outright denial of any historical plausibility. The skeptical grounds similarly vary, from distrusting the historical veracity of late and/or perhaps biased commentators, to understanding these thinkers (...) as involved in radically different projects. This essay aims to challenge the skeptical position, and establish a direct link disseminating Ionian philosophy to Magna Graecia via Xenophanes and Parmenides. The argument is straightforward. First, the ancient geographical and temporal evidence is noted, establishing that it was possible for Parmenides to have been influenced and/or taught by Xenophanes. Next, the metaphysical and epistemological parallels between these thinkers are considered. Despite notable differences, on balance, these close parallels suggest against the skeptical view, making it quite plausible to impute a direct intellectual link between these thinkers. Third, I consider ancient claims that both thinkers were engaging with religious topics, offering a sort of “rational theology.” This evidence for a close intellectual relationship between these thinkers has been entirely ignored by modern scholars, and orthodox interpretative models cannot readily provide a charitable explanation for them. However, by reconsidering the theistic content in Parmenides’s poem, a new interpretative approach is revealed which can. Once this evidence is considered in its totality, the case for imputing a close and direct intellectual heritage from Xenophanes to Parmenides proves quite substantial. (shrink)

Pragmatic arguments seek to justify the performance of an action by appealing to the benefits that may follow from that action. Pascal’s wager, for instance, argues that one should inculcate belief in God because there is everything to gain and little to lose by doing do. In this chapter I critically examine Pascal’s wager and William James’s famous “Will-to-Believe” argument by first explaining the logic of each argument and then by surveying the objections commonly arrayed against them. Finally, I suggest (...) that among the various versions of the wager found in Pascal’s Pensées is a neglected version that anticipates the Jamesian argument and that avoids the many-gods objection.
